Terms of Service
These Terms of Service ("Terms") govern access to and use of the iPOS Restaurant platform — including the point of sale, kitchen display, inventory, accounting, TableConnect QR ordering, kiosk, and related applications and services (together, the "Service") — operated by iPOS Soft ("iPOS", "we", "us"). By creating an account, starting a trial, or using the Service, you agree to these Terms on behalf of the business you represent ("you", the "Customer").
1. Accounts and eligibility
You must provide accurate business and contact information at signup and keep it current. You are responsible for all activity under your account and for safeguarding user credentials, PINs, and devices used to access the Service. The Service is offered to businesses, not consumers.
2. Free trial
Trials give full or partial access to the Service for a limited period at no charge. At the end of the trial the account may be suspended or limited until a paid subscription starts. We may modify or withdraw trial offers at any time; data from expired trials may be deleted after a reasonable retention period.
3. Subscriptions and billing
Paid plans are billed in advance on the agreed cycle through our payment processor. Except where required by law, fees are non-refundable. We may change pricing with reasonable advance notice; changes apply from your next billing cycle. Taxes are your responsibility unless stated otherwise.
4. Acceptable use
- Do not use the Service to violate any law or the rights of others.
- Do not attempt to gain unauthorised access to the Service, other tenants' data, or underlying infrastructure.
- Do not resell, sublicense, or provide the Service to third parties except as expressly agreed (e.g. under a partner agreement).
- Do not interfere with or disrupt the integrity or performance of the Service.
5. Your data
You retain all rights to the business data you enter into the Service (menus, orders, inventory, customer records, and similar). You grant us the rights needed to host, process, back up, and display that data to operate and improve the Service. Our handling of personal data is described in the Privacy Policy. You are responsible for the lawful collection of your own customers' data, including consent where required.
6. Availability and support
We work to keep the Service available and performant, including offline-capable features for store operations, but the Service is provided "as is" and "as available". Planned maintenance and factors outside our control may affect availability. Support is provided via support@ipossoft.io.
7. Intellectual property
The Service, including its software, design, and documentation, is and remains the property of iPOS and its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for your business during your subscription.
8. Termination
You may stop using the Service at any time. We may suspend or terminate access for material breach of these Terms, non-payment, or unlawful use. After termination we will make your data available for export for a reasonable period before deletion, except where retention is required by law.
9. Limitation of liability
To the maximum extent permitted by law, iPOS is not liable for indirect, incidental, special, or consequential damages, or for loss of profits, revenue, or data. Our aggregate liability arising out of the Service is limited to the amounts you paid for the Service in the twelve months preceding the claim.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified through the Service or by email, and the version and date above will change. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law rules. Disputes are subject to the exclusive jurisdiction of the courts of Dubai, UAE.
